Introduction

The terms "you" and "your" refer to a consumer who submits a credit application ("Application") to obtain a loan in connection with RoadLoans auto loan through Santander Consumer USA Inc. ("we,""us," and "our"). By agreeing to receive information from us electronically, you will receive certain disclosures, notices, information and documents related to your Application and loan ("Documents") electronically, which may include through our web site(s), other web sites related to the Application, and your email address. The Documents you receive from us electronically will include, but are not limited to, the Application, this Consent for Electronic Documents, the Consent for Sharing and Use of Information, our Privacy Policy, the Consent for SMS/Texting, the Telephone Consumer Protection Act notice and notices of our credit decision about your Application. This Consent for Electronic Documents informs you of your rights regarding receiving these Documents electronically. You will be unable to submit an Application unless you consent to receiving Documents electronically. This consent applies to the financing transaction you are requesting and all documents and records that relate to it.

Hardware and Software Requirements

Before you decide to receive the Documents electronically, you must determine if you have the necessary hardware and software described below to access and retain the Documents. To access the Documents, you will need a working email address, Adobe Acrobat Reader, and a computer or other access device that can access the Internet using a web browser. To retain the Documents, the computer or access device must allow you to download and save Documents to a hard drive or external storage media, print web pages as well as embedded HTML files, or both. You should save and/or print this page to be sure you have the necessary hardware and software.

Withdrawing Consent

You may withdraw your consent to receive Documents electronically at any time by contacting us by telephone at 888-276-7202. If you do, we will continue the Application and loan process in non-electronic format at no charge to you. If you decide to withdraw your consent, any Document that we previously provided to you as an electronic Document will remain valid, enforceable, sufficient for its intended purpose, and unaffected by the withdrawal of your consent. If you decide to withdraw your consent for electronic Documents, you will not have the option later to receive Documents from us electronically.

The terms "You" and "your" refer to the consumer who submits an application for preapproval of an auto loan ("Application") with RoadLoans made by Santander Consumer USA Inc. ("we" "us" and "our").

You agree that:

1. We may, after preapproving your Application, disclose the following nonpublic personal information about you to nonaffiliated automobile dealers and nonaffiliated financial institutions or third parties participating in our RoadLoans program:

  • Identification and contact information about you that we received from your Application and/or related credit forms, such as your name, mailing address, email address, and telephone number; information about the vehicle(s) you may want to purchase that we received from your Application and/or related credit forms; and
  • Information about your transactions, experiences, and dealings with us, such as the amount, terms, conditions, and status of the loan we have preapproved based on your Application and/or related credit forms; and

2. We may, if we are unable to preapprove your Application , disclose the following nonpublic personal information about you to nonaffiliated financial institutions , creditors or third parties that may be able to arrange or provide you with dealer financing or an automobile loan that we cannot or will not provide:

  • Information about you that we received from your Application and/or related credit forms, such as your name, mailing address, email address, Social Security number, driver's license number, telephone number, income, assets and liabilities;
  • Information about you that we received from a consumer reporting agency, such as your consumer report and credit score.

You understand and agree that we are not responsible for any services that might be provided by nonaffiliated automobile dealers, financial institutions, creditors, or third parties.

You agree the nonaffiliated automobile dealers, financial institutions, creditors or third parties that receive the nonpublic personal information described above may use that information to contact you for their own business purposes to process your credit application, and that they may obtain additional information about you, including consumer reports, for this purpose.

You understand that your information sharing consent will remain in effect until you revoke or modify it. You may revoke your information sharing consent at any time.

We will maintain a true and correct copy of this Consent for Information Sharing. You are entitled to a copy of this Consent for Information Sharing upon request. We recommend you keep a copy of this Consent for Information Sharing for your own records.


If a mobile number is provided, we may text you information about your application.

RoadLoans does not charge to send or receive text messages as part of our application process. However, message and data rates may apply. Please consult with your wireless carrier for applicable text messaging fees.

We may modify or terminate our text messaging services from time to time for any reason and without notice, including the right to terminate text messaging without notice, without liability to you, any other user or a third party. We reserve the right to modify these Terms of Use from time to time without notice. Please review these Terms of Use from time to time so that you are timely notified of any changes.

Additionally, you agree that we may send any SMS Statement Notifications through your communication service provider in order to deliver them to you. You agree to provide a valid mobile phone number for these services. You further agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, cost and expenses (including reasonable attorneys’ fee) arising from your provision of a mobile phone number that is not your own or your violation of applicable federal, state or local law, regulation or ordinance. Your obligation under this paragraph shall survive termination of the Agreement. SMS Statement Notification is provided for your convenience only.


I consent and agree that RoadLoans (and its affiliates, agents, assigns and service providers) may monitor and record telephone calls regarding my account to assure the quality of service or for other reasons.

I also expressly consent and agree, in order to administer and service my account or to collect any amounts I may owe, RoadLoans (and its affiliates, agents, assigns and service providers) may contact me by telephone at any telephone number associated with my account that I provide now or in the future, including cellular phones, wireless telephone numbers or other wireless devices, regardless of whether I incur charges as a result.

I expressly consent and agree to RoadLoans (and its affiliates, agents, assigns and service providers) contacting me by the following methods including, but not limited to, any telephone dialing system, sending text messages or e-mails using any e-mail address I provide now or in the future, using manual calling methods, pre­ recorded/artificial voice messages and/or use of an automatic dialing device or system, as applicable.


Terms of Submitting Application

The terms “you” and “your” refer to each consumer applying for a RoadLoans auto loan made by Santander Consumer USA Inc. (“we,” “us,” and “our”).

Important information about procedures for opening a new account

To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver's license or other identifying documents.

You understand that a RoadLoans loan is available only through participating dealers. If you are preapproved, you must contact a dealer to complete the loan transaction. We will share your application with the dealer selected. Our approval, however, may be used at any participating dealer (please see our website for more participating dealers). Our preapproval may be affected by the vehicle you select (e.g., vehicle age and mileage), any trade-in vehicle, the amount of your cash down payment and your creditworthiness.

You understand that this is an application for a preapproval of a loan and that it may not provide sufficient information to make a final credit decision. Any preapproval is subject to final credit approval, factors that are not available at the time of the online credit application and verification of identity and all information provided.

You agree that we (and the dealer) may obtain credit reports about you to process your application and for legitimate purposes related to any RoadLoans auto loan you might receive (such as reviewing, collecting, and servicing the loan). Buying and Refinancing Requirements

  • Minimum loan amount is $5,000 ($10,001 in Arizona)
  • Maximum loan amount is $75,000
  • Vehicles to be financed must be nine years old or newer with fewer than 120,000 miles. For example, in calendar year 2015, only model years 2006 and newer are eligible. Vehicles to be refinanced must be seven years old or newer with fewer than 105,000 miles. Vehicles purchased from an individual must be 12 years or newer with fewer than 100,000 miles. Vehicle restrictions apply. Maximum Mileage restrictions may apply.
  • The vehicle must have a clean and clear title and the vehicle cannot have a salvaged, lemon law, flood or frame damaged title
  • We do not offer financing for commercial vehicles, motorcycles or recreational vehicles.
  • Contracts with Santander Consumer USA, Inc. as the current lien holder are ineligible for refinance.
  • Contracts with Chrysler Capital as the current lien holder are ineligible for refinance.
  • Must be 18 years of age or older.
